सुप्रीम कोर्ट ने केंद्र से पूछा, सूचना आयुक्त के पद पर सिर्फ नौकरशाहों की ही नियुक्ति क्यों?

नई दिल्ली: सुप्रीम कोर्ट ने मंगलवार को केंद्र से पूछा कि सूचना आयुक्त के पद पर नियुक्ति के लिए सर्च कमेटी द्वारा केवल सेवानिवृत्त या कार्यरत नौकरशाहों को ही क्यों शॉर्टलिस्ट किया गया और विशेषज्ञों को नहीं.

जस्टिस एके सीकरी और जस्टिस एस. अब्दुल नज़ीर की पीठ को सरकार ने बताया कि मुख्य सूचना आयुक्त और चार सूचना आयुक्तों की नियुक्ति पहले ही की जा चुकी थी, जबकि अन्य सूचना आयुक्तों की नियुक्ति की प्रक्रिया चल रही है.

केंद्र की ओर से पेश अतिरिक्त सॉलिसिटर जनरल (एएसजी) पिंकी आनंद ने कहा कि सर्च कमेटी ने सूचना आयुक्तों की नियुक्ति के लिए चयन समिति द्वारा विचार के लिए 14 नामों की सिफारिश किया था.

इस पर पीठ ने पूछा, ‘इन 14 नामों में नौकरशाहों (सेवानिवृत्त या कार्यरत) के अलावा कोई और है?’ इस पर, एएसजी ने कहा कि 14 व्यक्तियों में से एक सेवानिवृत्त न्यायाधीश है जबकि बाकी नौकरशाह हैं.

फिर पीठ ने एएसजी से कहा, ‘उनकी (याचिकाकर्ताओं) आपत्ति है कि इस सूची में केवल नौकरशाह हैं. मतलब, आपको नौकरशाहों के अलावा एक भी व्यक्ति नहीं मिला.’

पीठ ने यह भी कहा कि सर्च कमेटी में सिर्फ नौकरशाह ही हैं. शीर्ष अदालत आरटीआई कार्यकर्ताओं अंजलि भारद्वाज, कोमोडोर लोकेश बत्रा (सेवानिवृत्त) और अमृता जौहरी की याचिका पर सुनवाई कर रही है जिन्होंने दावा किया है कि 23,500 से अधिक अपीलें और शिकायतें केंद्रीय सूचना आयुक्त के पास लंबित हैं क्योंकि सूचना आयुक्तों के पद खाली पड़े हैं.

सुनवाई के दौरान, एएसजी ने अदालत को बताया कि सूचना आयुक्तों की नियुक्ति की प्रक्रिया चल रही है और सरकार आरटीआई अधिनियम के तहत निर्धारित चयन मानदंडों का पालन कर रही है.

द हिन्दू मुताबिक जस्टिस सीकरी ने कहा, ‘हम नियुक्तियों को दोष नहीं दे रहे हैं. ऐसे नाम थे जो नौकरशाह नहीं थे, लेकिन उनमें से एक को भी नियुक्त नहीं किया गया. धारणा यह है कि उन्हें लगता है कि इस तरह के पदों के लिए एकमात्र नौकरशाह वर्ग योग्य है.’

याचिकाकर्ताओं की ओर से पेश अधिवक्ता प्रणव सचदेवा ने कहा कि राज्य सूचना आयोगों (एसआईसी) में मामलों को सूचना आयुक्तों की कमी के कारण वर्षों से लंबित रखा गया है और पश्चिम बंगाल में, 2008 में दर्ज मामलों का अब फैसला किया जा रहा है.

उन्होंने कहा कि 13 दिसंबर 2018 को सुप्रीम कोर्ट ने आदेश दिया था कि सरकार सर्च कमेटी के सभी सदस्यों के नाम, शॉर्टलिस्ट किए गए कैंडिडेट और चयन के लिए क्या तरीका फॉलो किया जा रहा है, इन सभी जानकारी को वेबसाइट पर अपलोड करे.

लेकिन सरकार के सभी चार सूचना आयुक्तों की नियुक्ति के बाद ये सभी जानकारी वेबसाइट पर अपलोड किया.

सचदेवा ने कहा, ‘यह जानकारी नियुक्ति की प्रक्रिया के दौरान सार्वजनिक की जानी चाहिए थी, न कि नियुक्ति के बाद. पूरी प्रक्रिया में पारदर्शिता की जरूरत है.’

उन्होंने कहा कि सरकार केवल सेवानिवृत्त या कार्यरत नौकरशाह या सरकारी बाबुओं को सूचना आयुक्त के रूप में नियुक्त कर रही थी लेकिन नियुक्ति के लिए कार्यकर्ताओं, वैज्ञानिकों, पत्रकारों, वकीलों और अन्य जैसे व्यक्तियों के नामों पर भी विचार किया जाना चाहिए.

एएसजी ने अदालत को बताया कि सरकार ने मुख्य सूचना आयुक्त और सूचना आयुक्तों की नियुक्ति की प्रक्रिया के दौरान आवश्यकताओं का अनुपालन किया है और विवरण वेबसाइट पर अपलोड किए गए हैं.

उन्होंने कहा कि इस प्रक्रिया में 280 अभ्यर्थियों ने आवेदन किया था और कुछ रिक्तियों को भरा गया था, जबकि अन्य के लिए प्रक्रिया जारी है.

पश्चिम बंगाल की ओर से पेश वकील ने पीठ को बताया कि उनके पास पहले से ही एक राज्य के मुख्य सूचना आयुक्त और तीन राज्य सूचना आयुक्त हैं और वे छह महीने के भीतर स्थिति की समीक्षा करेंगे और देखेंगे कि क्या उन्हें और राज्य सूचना आयुक्तों की जरूरत है.

इसी तरह, आंध्र प्रदेश के वकील ने कहा कि उनके पास तीन राज्य सूचना आयुक्त हैं और एक खाली पद को भरने की प्रक्रिया पहले से ही चल रही है. याचिकाकर्ताओं के वकील ने पीठ को सूचित किया कि उत्तर प्रदेश में 10 राज्य सूचना आयुक्त हाल ही में सेवानिवृत्त हुए हैं और उन्होंने इस संबंध में अदालत में एक अलग आवेदन दायर किया है.

पीठ ने राज्यों से मौजूदा रिक्तियों को भरने के लिए उनके द्वारा उठाए गए कदमों का विवरण देते हुए दो-तीन दिनों के भीतर हलफनामा दाखिल करने को कहा. इससे पहले शीर्ष अदालत ने केंद्र और राज्यों को मुख्य सूचना आयुक्त और सूचना आयुक्तों की नियुक्तियों में पारदर्शिता बनाए रखने और वेबसाइट पर सर्च कमेटी और आवेदकों का विवरण अपलोड करने के लिए कहा था.

पिछले साल जुलाई में, शीर्ष अदालत ने मुख्य सूचना आयोग और राज्य सूचना आयोगों में खाली पदों पर चिंता व्यक्त की थी और केंद्र और सात राज्यों को पदों को भरने को लेकर समय सीमा बताने के लिए एक हलफनामा दायर करने का निर्देश दिया था.

अदालत ने सात राज्यों – महाराष्ट्र, आंध्र प्रदेश, तेलंगाना, गुजरात, केरल, ओडिशा और कर्नाटक से कहा था कि वे पदों को भरने के लिए समय सीमा के बारे में जानकारी दें.

याचिकाकर्ताओं ने कहा है कि गुजरात और महाराष्ट्र जैसे कई सूचना आयोग मुख्य सूचना आयुक्त के बिना काम कर रहे हैं. आरटीआई अधिनियम में इस पद के लिए एक महत्वपूर्ण भूमिका है, जिस पर आयोग का प्रशासन संभालने का भी काम होता है.

On this, the bench asked, ‘Is there any other than bureaucrats (retired or employed) in these 14 names?’ On this, ASG said that one of the 14 persons is a retired judge whereas the rest are bureaucrats.

Then the bench told the ASG, “His (petitioners) objection is that there are only bureaucrats in this list. Meaning, you have not got a single person besides the bureaucrats. ‘

The bench also said that there are only bureaucrats in the search committee. The apex court is hearing a petition filed by RTI activists Anjali Bharadwaj, Commodore Lokesh Batra (Retd) and Amrita Johari, who claimed that more than 23,500 appeals and complaints are pending with the Central Information Commission, because the posts of Information Commissioners are vacant.

During the hearing, the ASG told the court that the process of appointment of Information Commissioners is in progress and the government is following the prescribed norms under the RTI Act.

According to The Hindu, Justice Sikri said, ‘We are not blaming the appointments. There were names that were not bureaucrats, but none of them was also appointed. The impression is that they think that the only bureaucrat class is eligible for such posts. ‘

Advocate Pranav Sachdeva, appearing on behalf of the petitioners, said that the matters in the State Information Commissions (SIC) have been pending for years due to the lack of information commissioners and in West Bengal, the cases filed in 2008 are now being decided.

He said that on December 13, 2018, the Supreme Court had ordered that the names of all the members of the Government Search Committee, the shortlisted candidates and the method of selection are being followed, upload all these information to the website.

But after the appointment of all the four Information Commissioners of the government, upload all these information to the website.

Sachdeva said, “This information should have been made public during the process of appointment, not after the appointment. Transparency is needed in the entire process. ‘

He said that the government was only appointing retired or working bureaucrats or government officers as information commissioners, but names of workers, scientists, journalists, lawyers and others should also be considered for appointment.

The ASG told the court that the government has complied with the requirements during the process of appointing Chief Information Commissioner and Information Commissioners and details have been uploaded on the website.

He said that 280 applicants had applied in this process and some vacancies were filled, while the process for the other was going on.

The counsel appearing on behalf of West Bengal told the bench that he is already a Chief Information Commissioner of the state and three State Information Commissioners and they will review the situation within six months and will see whether they need more State Information Commissioners. is.

Similarly, the advocate of Andhra Pradesh said that he has three state information commissioners and the process of filling an empty post is already underway. Advocate of the petitioners informed the bench that 10 state Information Commissioners have been retired recently and they have filed a separate application in this regard in the court.

The bench asked the States to file an affidavit within two to three days giving details of the steps taken by them to fill the vacancies of the existing vacancies. Earlier, the apex court asked the Center and states to maintain transparency in the appointments of the Chief Information Commissioner and Information Commissioners and to upload the details of the search committee and applicants on the website.

In July last year, the apex court had expressed concern over vacant posts in the Chief Information Commission and State Information Commissions and directed the Center and seven states to file an affidavit to fill the deadline for filling posts.

The court had told the seven states – Maharashtra, Andhra Pradesh, Telangana, Gujarat, Kerala, Odisha and Karnataka that they would give information about the time frame for filling up the posts.

The petitioners have said that many information commissioners like Gujarat and Maharashtra are working without the Chief Information Commissioner. There is an important role for the post in the RTI Act, which is also the work of managing the administration of the Commission.

Arguments have been claimed that the Central and State Governments have tried to ‘fail’ the functioning of the RTI Act in fulfilling their statutory duties to ensure the appointments in a timely manner.
